An introduction to aspects of health law: bioethical principles, human rights and the law

Abstract


There is a link between bioethical principles, human rights and the law. Aspects of the principles of autonomy, beneficence, non-maleficence and justice can be found in the South African Constitution and the country’s statute and common law. A breach of these ethical principles and the Constitution may sometimes lead to an action for medical malpractice or professional negligence.

In this paper it is intended to explore the link between the bioethical principles, human rights and the law.
