Delictual liability is a legal minefield at the best of times, and this article demonstrates that it is particularly problematic for junior doctors and their employers. What is gratifying to note is that junior doctors and the Department of Health are proactively seeking solutions to excessive and potentially harmful working hours. Nurses and nursing agencies are also open to exploitation and require further monitoring.
